Our flight was from Warsaw Chopin Airport to Barcelona El Prat International Airport. We successfully checked in and were waiting for the boarding. We were waiting for the boarding in front of the gate…and waiting , and waiting…Nothing was happening, no-one was inviting us to the boarding, no-one was telling us what was going on. All the passengers were a bit worried because a lot of us had flight connection in Barcelona. As the result, flight was delayed for more than 3 hours!
Representatives of an airline did apologize and gave us compensation voucher of 50 euros amount the we could use for the next flight. This voucher we could only use while buying a ticket for the next flight, and we couldn’t take it in cash.

According to EC 261 regulations each passenger should have been given a compensation of 250 euros for this flight delay. Actually what happened was that passengers who did accept the voucher legally lost their right for the flight delay compensation. And this is exactly what an airline wanted you to do. But the passengers who didn’t accept the voucher and got in touch with us got 250 euros compensation for the flight delay!
Let’s do some calculations to check an airline profit in this situation, according to the fact that there were 70 passengers on that flight!
We multiply 70 passengers by 50 euros (a voucher that you can only use for the next flight with this airline) = 3500 euros.
In case of paying compensation by EC 261 regulation:
We multiply 70 passengers by 250 euros (in cash) = 17500 euros.
Perhaps now you understand why the representatives of the airline were so polite with you? Their smile was worth 17,500 euros of unpaid compensation. Won't you smile for that kind of money?

Flight: London - Frankfurt.
Flight delay time: unspecified.

This summer i've been flying to London from Frankfurt on a business trip. On my way back to Frankfurt there was a flight delay. Just before the boarding we were announced that the flight was delayed for a while. Later they announced the the flight is delayed till tomorrow due to the technical issues. An airline provided rooms in the hotel to all passengers. As I finally got back home I decided to get in contact with an airline, because I had a legal right for the flight delay compensation and also for the compensation of the expenses. I sent an email describing the situation, attached invoices from the hotel, shop, boarding pass, certificate of the flight delay, my passport with stamps of passing check in, my bank account details and asked them to pay the compensation around 450 euros (250 euros is the flight delay compensation, rest was the expenses: hotel, transfer, water, they gave vouchers for food so there was no need to compensate food price).
I’ve been calling them for 2 month…Finally they sent me an email saying that I don’t have the right for the flight delay compensation because the delay was not their fault. Although we were told that flight delay was due to the technical issues. After 3 month of negotiating with an airline, of all that stress, an airline did make a bank transfer of 100 euros to my bank account. I just felt that I can’t keep it going on and on and on. So I took these 100 euros and stopped arguing.

According to EC 261 regulations each passenger of this flight should have been paid 250 euros as the flight delay compensation. Also full amount of expenses (hotel, transfer, food (if they didn’t give food vouchers)). Aprox amount is 450 euros. Instead passenger accepted 100 euros, and as a result lost 350 euros.
Let's do some calculations? Concerning only this flight, which registered 120 passengers.
120 passengers х 350 euros = 42 000 euros. And this money we left inside the airline. Now you do understand why airlines layers are so polite and so well paid?
This politeness did cost passengers 42 000 euros. That is why airline pay so well to their lawyers!

Flight: Zurich - Borispol.
Overbooking.

An airline didn’t pay flight delay compensation to a passenger. A passenger talked about it on her Facebook page. Her mother and here were flying to Borispol from Zurich on May 29th. During the check in they were offered a compensation in case they agree to take another flight (later this day and with the connection in other airport). «They offered us 100 euros of compensation, then 200 euros but we didn’t agree. When they offered 400 euros compensation for each we decided to agree and take that flight. They changed our tickets and promised that the compensation will be paid into our bank account during 24 hours» - thats what she wrote on her Facebook page. Should we mention that she never got the compensation?

In accordance with the rules of Regulation EC 261, if a passenger accepts compensation from the airline in any form for excess bookings, he automatically loses the right to claim compensation. Never give up your right to compensation for excess bookings! In the event of an excess booking, it is quite difficult to fix in writing your right to compensation and the right to refuse, and this is what the airline took advantage of.

Flight delay: 16 hours.

10th of August 2018 more than 120 passengers we waiting departure from London for over 16 hours. They had to sleep on the floor, and of course they were furious about the situation. Passengers were not provided with food or water or hotel, actually they were not even provided with the information what is going on. Passengers were waiting in front of the boarding gate during 7 hours and later they were told that due to technical issues their flight will be operated tomorrow. «We had to wait in from of the gate there were no chairs, but we couldn’t sit on the floor because it was too cold, so we had to stand all 7 hours just waiting for any news. The way and airliner representative behaved was just unacceptable. No information was provided, no food, no water!» - says Vitaliy Rusu, in his compensation claim.
As a response to this claim, an airline reminded Vitaliy that they take care of passengers safety on board and an airline made right decision according to safety on board. Airline just ignored the question what really happened and why the flight was delayed. An airline thanked the passenger for contacting them for the flight compensation and wish to see him and his family as their passengers in the nearest future.

According to EC 261 Regulation each passenger should have been paid 400 euros compensation for there flight delay. Also full compensation of all expenses should have been paid to each passenger. And that could be around 650 euros.
Let's calculate the airline’s profit from the fact that it did not pay compensation.

I’ve decided to wait what an airline would offer me. In the first email an airline said they would offer me another flight or full amount compensation. And they did offer me a flight to Helsinki with the connection in Frankfurt. That didn’t work for me, so I declined that option and had to buy new tickets.
A week later I filled in the compensation form on an airline website. That was standard, flight number, contact details and reason for claiming a compensation. There you can attache invoices, emails and actually all the documents that you have about the flight. I filled in all the details and said that an alternative route that an airline offered was way different from the original one.
Three weeks later I got airline response - Compensation declined due to the strike at the airport.

According to EC 261 regulations each passenger should have been given flight cancellation compensation or an alternative option to their destination. Till 2018 strike was considered as a force majeure, but in April 2018 it was stated that in case of strikes an airline must pay flight delay and flight cancellation compensation.
Let’s do some calculations…flight cancellation compensation for the flight Venice - Paris (1500 km) is 250 euros.
120 passengers were just on this flight. And there are a lot of daily flights. As a result, if a passenger doesn’t know about their rights an airline can save 30 000 euros just on one flight. And how many flights were delayed and canceled that day? An amount of unpaid compensations is just huge!
